Georgetown – The High court on Thursday fixed Feb 11, to decide on the quantum for damages in a medical negligence suit that was won by former national junior athlete, Nor Azleen Mohammad Mustafa.
Nor Azleen, 24, through her counsel Dr N. Ahilan said Nor Azleen had filed a claim for RM4.6 million in general and special damages.
Ahilan said a date was fixed to allow submissions from both parties that would be heard before Judicial Commissioner Datuk Azmi Ariffin.
Nor Azleen, a former 100m sprinter who represented Penang and Malaysia in junior championships, had filed a medical negligence suit against Dr Omar Md Isa of the Universiti Malaya Medical Faculty’s Orthopedic Department and Universiti Malaya Medical Centre (UMMC) several years ago after she was left partially paralyzed from a spinal surgery on Sept 3, 2005.
Following the Penang High Court’s decision to dismiss her suit on Nov 9, 2012, Nor Azleen filed an appeal to the Court of Appeal.
On July 21 last year, a three-member Court of Appeal (COA) panel led by Justice Mohd Hishamudin Mohd Yunus allowed her appeal. – Bernama
